Class Action (credit cards). Join your voice to ours!

These Class Action suits target the three following commercial practices:
 
1. Loss of grace period

You are a member of this Class Action if you paid interest on your transactions even though you respected the grace period:
  • With your Amex Bank of Canada card, between July 18, 2000 and August 31, 2010 (Class action n° 500-06-000203-030)
  • With your Royal Bank of Canada, Citibank Canada or MBNA Canada cards, between August 2, 2000 and August 31, 2010 (Class action n° 500-06-000375-069)
If you wish to be excluded from the class action, you must advise the Clerk of the Superior Court, District of Montreal, by courier or registered mail. The Clerk’s address is 1,  Notre-Dame Street East,  Suite 1.01, Montreal (Quebec) H2Y 1B6, and the Clerk must be informed no later than January 10th, 2011 that you are a member of the group described in the class action bearing docket number n° 500-06-000203-030 or in the class action bearing docket number 500-06-000375-069 and that you wish to be excluded from these proceedings.

2. Increased limit and overlimit charges
2A- You are a member of this Class Action if you were granted, without express request on your part, an increase in your credit limit and that have you used this increased credit:
  • With your Bank of Montreal card between January 9, 2001 and December 31, 2009. (Class action n° 500-06-000221-040)
  • with your Royal Bank of Canada, Canadian Imperial Bank of Commerce, National Bank of Canada, Citibank Canada or MBNA Canada card between January 12, 2001 and December 31, 2009. (Class action n° 500-06-000372-066)
2B - You are a member of this Class Action if you paid charges because you exceeded your credit limit:
  • With your Citibank Canada card between January 9, 2001 and September 30, 2010. (Class action n° 500-06-000221-040)
  • With your Bank of Montreal, Royal Bank of Canada, Canadian Imperial Bank of Commerce, Bank of Nova Scotia, Amex Bank of Canada, Citibank Canada or MBNA Canada card between January 12, 2001 and September 30, 2010. (Class action n° 500-06-000372-066)
If you wish to be excluded from the class action, you must advise the Clerk of the Superior Court, District of Montreal, by courier or registered mail. The Clerk’s address is 1,Notre-Dame Street East, Suite1.01, Montreal (Quebec) H2Y1B6, and the Clerk must be informed no later than January 10th, 2011 that you are a member of the group described in the class action bearing docket number 500-06-000221-040 or in the class action bearing docket number 500-06-000372-066 and that you wish to be excluded from these proceedings.

3. Cash advances
You are a member of this Class Action if you paid charges for cash advance transactions in Canada or abroad:
  • With your Canadian Tire Bank card between October 1, 2001 and September 30, 2010. (Class action n° 500-06-000249-041)
  • With your Bank of Montreal, Royal Bank of Canada, Toronto Dominion Bank, Fédération des Caisses the Desjardins du Québec, Canadian Imperial Bank of Commerce, Bank of Nova Scotia, National Bank of Canada, Laurentian Bank of Canada, Amex Bank of Canada, Citibank Canada, MBNA Canada or the President’s Choice Bank, between October 4, 2001 and September 30, 2010. (Class action n° 500-06-000373-064)
If you wish to be excluded from the class action, you must advise the Clerk of the Superior Court, District of Montreal, by courier or registered mail. The Clerk’s address is 1, Notre-Dame Street East, Suite 1.01, Montreal (Quebec) H2Y1B6, and the Clerk must be informed no later than January 10th, 2011 that you are a member of the group described in the class action bearing docket number n° 500-06-000249-041 or in the class action bearing docket number 500-06-000373-064 and that you wish to be excluded from these proceedings.

We should point out that the class action suits have been certified for certain financial institutions only. Option consommateurs will therefore appeal in order to include all consumers penalized by these abusive commercial practices.
